The opportunity
The Real Estate Council of Alberta (RECA) is seeking a Legal Counsel to join its Conduct Counsel team. This role supports RECA’s regulatory mandate by preparing and presenting professional disciplinary matters under the Real Estate Act and Rules.
Legal Counsel are responsible for researching legal issues, drafting hearing documents and legal arguments, and presenting cases on behalf of the Registrar before Hearing Panels. The role also includes conducting appeals on behalf of the Registrar, Industry Councils, and the RECA Board, as well as appearing in court on conduct‑related applications when required.
In addition to advocacy work, Legal Counsel advise and support members of the Investigations Team throughout the conduct process, providing legal guidance on allegations of professional misconduct and contributing to fair, well‑informed decision‑making.
This position is well suited to a lawyer with experience in professional discipline hearings, criminal or quasi‑criminal prosecution, or plaintiff‑side civil litigation, who is interested in applying those skills in an administrative law and regulatory environment. The work requires careful assessment of evidence, sound judgment, and respect for procedural fairness in matters that can be complex or contested.
As a not‑for‑profit regulator, RECA serves the public interest. Legal Counsel act on behalf of the Registrar and exercise discretion in a manner that supports public protection, informed regulatory outcomes, and professional standards across Alberta’s real estate‑related industries.
Role & responsibilities
prepare cases for presentation, including researching legal issues, and drafting hearing documents and legal arguments
present cases on behalf of the Registrar before Hearing Panels
conduct appeals on behalf of the Registrar, Industry Councils, and the RECA Board
advise and support members of the Investigations Team, who investigate allegations of professional misconduct
occasionally appear in court on conduct proceeding applications
Skills & qualifications
Required
member in good standing with the Law Society of Alberta, or eligible to be admitted
strong legal research, drafting and analytical skills
interest in a litigation role
demonstrated ability to assess evidence and present reasoned legal arguments
Preferred
2-5 years of legal experience, particularly in one or more of the following:
o professional discipline or administrative hearings
o criminal or quasi-criminal prosecution
o plaintiff-side civil litigation involving contested proceedings
experience exercising judgment in matters involving procedural fairness and public interest considerations
detail-oriented with strong judgment and analytical skills
proficiency in the Microsoft Office Suite, Teams, and experience using case management software
